These Terms of Use ("Terms") govern your use of the Pocket Raws application ("Pocket Raws" or "Application"), operated by JBFilms ("JBFilms," "us," or "we").
By accessing and using Pocket Raws, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms and the Privacy Policy. If you do not accept these Terms, you are not authorized to use the Application. We may modify these Terms at any time, and such modifications will take effect upon posting to the Application.
JBFilms values your privacy and ensures that your personal information is handled as outlined in our Privacy Policy. By using the Application, you consent to the collection and use of information necessary to provide localized Raws Data and improve the Application's services.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JBFILMS AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
JBFILMS MAKES NO WARRANTY THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS FROM THE USE OF THE APP WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE APP WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JBFILMS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR ANY OTHER LOSS) ARISING OUT OF OR IN CONNECTION WITH THE USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF JBFILMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOU ACKNOWLEDGE THAT THE APP RELIES ON THIRD-PARTY DATA SOURCES AND SERVICES AND THAT INTERRUPTIONS, DELAYS, OR INACCURACIES MAY OCCUR. JBFILMS IS NOT RESPONSIBLE FOR THE AVAILABILITY, ACCURACY, CONTENT, OR RESULTS OF USE OF SUCH THIRD-PARTY DATA SOURCES AND SERVICES. YOU AGREE THAT JBFILMS IS NOT RESPONSIBLE FOR ANY DAMAGES OR LOSSES RESULTING FROM INACCURATE, DELAYED, OR INCOMPLETE INFORMATION OBTAINED THROUGH THE APP.
THE APP IS NOT INTENDED TO BE USED AS A PRIMARY SAFETY OR EMERGENCY NOTIFICATION SYSTEM. POCKET RAWS SHOULD BE USED FOR INFORMATIONAL PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS THE SOLE SOURCE OF INFORMATION IN SITUATIONS WHERE PRECISE WEATHER INFORMATION IS CRITICAL FOR PERSONAL SAFETY OR PROPERTY PROTECTION.
YOU UNDERSTAND AND ACKNOWLEDGE THAT PUSH NOTIFICATIONS MAY BE DELAYED OR MAY NOT BE DELIVERED DUE TO FACTORS BEYOND JBFILMS' CONTROL, INCLUDING BUT NOT LIMITED TO CELLULAR NETWORK ISSUES, SERVER DOWNTIME, DEVICE SETTINGS, OR OTHER TECHNICAL FACTORS. JBFILMS IS NOT LIABLE FOR ANY DAMAGES RESULTING FROM YOUR RELIANCE ON NOTIFICATIONS OR OTHER INFORMATION PROVIDED THROUGH THE APP.
DURING EMERGENCIES OR CRITICAL WEATHER EVENTS, USERS SHOULD CONSULT OFFICIAL GOVERNMENT SOURCES, EMERGENCY SERVICES, AND OFFICIAL WEATHER SERVICES FOR CRITICAL SAFETY INFORMATION.
You acknowledge that the weather data, fire forecasts, and other Content displayed or provided to Users through Pocket RAWS is not our original content, but is exclusively based on data and other content supplied to us by third-party data providers (the "Supplied Content"). Our Services do not involve interpretation of the Supplied Content, nor do we provide Users with any meteorological or forecasting services.
The nature of our Services is merely to process the Supplied Content and, where appropriate, interpolate the input data (including weather forecast data), in order to display and visualize it within Pocket RAWS. For the purpose of these Terms, "interpolate" includes generating derived Content from the Supplied Content based on predetermined algorithms and combining Supplied Content from more than one data source.
Given that JBFilms has limited control over the Supplied Content, we accept no responsibility whatsoever for such Supplied Content as it is displayed or provided in Pocket RAWS, especially regarding its correctness, completeness, timeliness, and accuracy. This disclaimer applies to you as a User of our Services and to any third parties, regardless of the platform or services by which the Supplied Content will be displayed, made accessible, or used.
All RAWS station data, fire weather forecasts, preparedness levels, and related information come from external sources that are beyond our control. The app's notifications and alerts are triggered based on these external data sources, and we cannot guarantee their accuracy or timely delivery.
Pocket Raws offers subscription-based features. Subscriptions are billed on a recurring basis (monthly or annually) through your App Store account. Your subscription will automatically renew unless canceled at least 24 hours before the end of the current period.
You can manage or cancel your subscription through your App Store account settings. Subscription fees are non-refundable, and any changes to subscription terms will require user consent.
All content within Pocket Raws, including but not limited to visual designs, code, and graphics, is owned by JBFilms. Unauthorized distribution, modification, or reproduction of this content is strictly prohibited.
Pocket Raws may contain links to third-party websites or services. JBFilms is not responsible for the content, privacy policies, or practices of these third-party sites. Users access such content at their own risk.
JBFilms reserves the right to terminate access to Pocket Raws at any time without prior notice. Upon termination, your rights to use the Application will cease immediately.
These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or the use of Pocket Raws shall be resolved within the jurisdiction of California courts.
